The terms that govern your use of www.nebulacraftdesign.com and any free resources, content, or general information we publish.
01Agreement to terms
These Terms of Service ("Terms") form a legal agreement between you and Nebula Craft Design Ltd, a company registered in England and Wales under company number 17180534, with registered address 61 Bridge Street, Kington, HR5 3DJ, United Kingdom.
By accessing or using www.nebulacraftdesign.com (the "Site") you agree to be bound by these Terms. If you do not accept these Terms, please do not use the Site.
These Terms govern your use of our website. Any client engagement, design, branding, development, or other professional services, is governed by a separate written agreement. Where the terms of that agreement conflict with these Terms, the written agreement prevails for matters relating to that engagement.
02Definitions
- "We", "us", "our", Nebula Craft Design Ltd.
- "You", "your", any person accessing or using the Site.
- "Site", the website at www.nebulacraftdesign.com and any subdomains.
- "Content", any text, images, graphics, audio, video, code, or other material published on the Site.
- "Services", any professional services offered by us under a separate written engagement.
03Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use this Site. By using the Site you represent that you meet these requirements.
If you are accessing the Site on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
04Use of the Site
We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for your personal or internal business purposes, subject to these Terms.
You agree not to:
- Use the Site for any unlawful, fraudulent, or harmful purpose.
- Attempt to gain unauthorised access to the Site, its servers, or any related systems or networks.
- Probe, scan, or test the vulnerability of the Site or breach any security or authentication measures.
- Use any robot, spider, scraper, or other automated means to access the Site without our prior written consent.
- Introduce any virus, malware, or other malicious code to the Site.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Reverse engineer, decompile, or attempt to derive the source code of any part of the Site.
- Use the Site in any manner that could disable, overburden, damage, or impair it.
We reserve the right to suspend or terminate your access to the Site at any time, without notice, if we believe you have breached these Terms.
05Intellectual property
All Content on the Site, including but not limited to text, design, logos, graphics, animations, code, and arrangement, is owned by us or our licensors and is protected by United Kingdom and international copyright, trademark, and other intellectual property laws.
You may not copy, reproduce, distribute, publish, transmit, modify, create derivative works from, publicly display, or otherwise exploit any Content from the Site without our prior written permission, except as expressly permitted by these Terms or by applicable law.
"Nebula Craft Design" and our logo are trademarks of Nebula Craft Design Ltd. All other trademarks displayed on the Site are the property of their respective owners.
06Client engagements
Where we agree to provide Services to you under a separate written engagement, that engagement governs:
- The scope of work and deliverables
- Fees, payment terms, and invoicing
- Intellectual property ownership and licences for deliverables
- Revisions, change requests, and acceptance
- Confidentiality and non-disclosure obligations
- Warranties, liability, and indemnities specific to the engagement
- Termination of the engagement
Enquiries are not service contracts
E01, an email, a call, a quote or estimate, a proposal discussion, or another project conversation is an enquiry or communication. None of those steps by itself forms a contract for Services.
Nothing on this Site constitutes an offer to provide Services or creates any binding obligation on us to perform work. A client engagement is formed only when the relevant proposal, statement of work, contract, or equivalent written agreement is expressly accepted in the manner specified by that agreement.
07Consumer customers
We may provide Services to businesses, organisations, and private individual consumers. If you are a consumer, applicable consumer law and your statutory rights continue to apply.
We do not contract out of mandatory consumer rights or use these Terms to remove consumer remedies. Before a relevant distance service contract is concluded, the applicable contracting materials will provide the required service, price, performance, duration, and cancellation information.
Where Services begin during an applicable cancellation period, the relevant written agreement will address the express consumer request, payment for work supplied where legally permitted, and any circumstances in which full performance can affect the cancellation right.
08User submissions
If you submit information to us through the Site, for example via a contact form, email, or other communication, you confirm that:
- The information is accurate and not misleading.
- You have the right to submit it and to share it with us for the purposes described in our Privacy Policy.
- The information does not infringe the rights of any third party or violate any applicable law.
We may use information you submit to respond to your enquiry, prepare a proposal, and otherwise communicate with you about potential work. Our handling of personal data is governed by our Privacy Policy.
09Third-party links and content
The Site may contain links to third-party websites, tools, or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or operation of any third-party site. Linking is provided for convenience and does not constitute endorsement.
When you leave our Site to visit a third-party site, you do so at your own risk and subject to that site's own terms and policies.
10Disclaimers
The Site and its Content are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we make no representations or warranties of any kind, express or implied, regarding the operation of the Site, the accuracy or completeness of its Content, or the availability or reliability of any services described on it.

11Limitation of liability
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence.
- Fraud or fraudulent misrepresentation.
- Your statutory consumer rights, including the right to have Services performed with reasonable care and skill where applicable.
- Any other liability which cannot be lawfully limited or excluded under the laws of England and Wales.
Subject to the above, to the maximum extent permitted by law:
- We will not be liable for any indirect, incidental, special, consequential, or punitive losses, including loss of profit, revenue, business opportunity, anticipated savings, goodwill, or data.
- Our total aggregate liability arising out of or in connection with your use of the Site is limited to one hundred pounds sterling (£100).
- Liabilities arising out of any client engagement are governed by the separate written agreement for that engagement, not by these Terms.
Nothing in these Terms excludes or restricts a consumer remedy or any liability that the law does not allow us to exclude or restrict.
12Indemnity
You agree to indemnify and hold harmless Nebula Craft Design Ltd, its directors, employees, and contractors from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with your breach of these Terms or your misuse of the Site, to the extent permitted by law.
This indemnity does not require a consumer to give up a mandatory consumer right or remedy.
13Termination
We may suspend, restrict, or terminate your access to the Site at any time, without notice, for any reason, including suspected breach of these Terms. Sections of these Terms that by their nature should survive termination will do so, including provisions relating to intellectual property, liability, indemnity, and governing law.
14Changes to these Terms
We may update these Terms from time to time. The "Effective date" at the top of this page indicates when the Terms were last revised. Your continued use of the Site after a revision becomes effective constitutes your acceptance of the updated Terms.
15Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales.
For business or organisational users, the courts of England & Wales will have jurisdiction subject to the relevant written agreement.
If you are a consumer, this section does not remove any mandatory consumer protections or applicable jurisdiction rights.
16General
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any provision of these Terms will not be deemed a waiver of that provision.
These Terms constitute the entire agreement between you and us regarding your use of the Site, and supersede any prior agreements between you and us relating to its subject matter.
